The driver was identified as Jared Wells Herbert, 40, of 304 Love Point Ave., Stevensville, Maryland. Upon contact with Herbert, Trooper First Class Holson detected the strong odor of an alcoholic beverage, as well as the odor of marijuana.

Officers had responded to the report of an intoxicated woman lying in the bushes. When officers attempted to take her into custody, the woman kicked and bit the hand of one of the officers.
