Shockley nabbed poaching again is no shock

WINGATE, MD. — A Toddville Waterman has been apprehended once again as he pursued the pirate poaching career that he has apparently nurtured for years.

Natural Resources Police reports that the Dorchester County waterman received 11 citations totaling $5,055 in fines on Feb. 5, 2016, from NRP Officer M. Ferguson after officers caught him with 13 bushels of undersized oysters.

Jeremy Vincent Shockley, 42, of 2817 Toddville Road, Toddville, Md., was charged with harvesting undersized oysters, ranging from 7 percent to 37 percent below the 3-inch state minimum.

While patrolling the area around the Wingate county dock shortly after noon, officers saw a vessel, “Ka-Kee,” docking and approached Shockley. The Waterman told the officers that he had dumped his catch into a container that already held oysters. However, the buyer contradicted Shockley’s account and showed documentation of the purchase.

Officers returned the undersized oysters to state waters.

Shockley was found guilty in 2000, 2007, 2009 and 2012 of oyster poaching charges. He is scheduled to appear in Dorchester District Court on the latest charges on April 20, 2016.

Shockley was cited by NRP Officer R. Bowman for possession of unculled and undersize oysters on Dec. 2, 2011, and in Dorchester County District Court on March 18, 2012, he was found guilty and fined $177.50.

Shockley was charged with several counts of possession of undersized oysters on Feb. 2, 2009. He was found not guilty on two counts and one count was put on the Stet Docket for having more than his daily limit of oysters in Dorchester County District Court with no fine and no time.

Shockley was charged on Jan. 26, 2009 by NRP Officer H. Brohawn with possession of unculled and undersized oysters along with a slew of other poaching violations. In Dorchester County District Court on May 27, 2009, represented by attorney Russell C. Dashiell Jr., he got a plea deal from the Dorchester County States Attorney, which netted him a fine of $327.50 and no jail time.

Cited for power dredge for oysters after 3 pm on Feb. 12, 2007, by NRP Officer F. Sutton, Shockley was able to wangle a guilty plea deal on March 28, 2007, which caused him to pay a fine of $102.50.

Two charges of poaching oysters against Shockley by NRP Officer H. Brohawn on Dec. 19, 2008, resulted in the Dorchester County States Attorney deciding the cause of justice was best served by simply putting the charges on the Stet Docket with no fine and no time.

Cited for commercial oystering without a license on Oct. 28, 2006, by NRP Officer Lisa M. Gruber, Shockley found the St. Mary’s County States Attorney less hospitable to an Eastern Shore waterman. On Jan. 5, 2007, in St. Mary’s District Court, his plea deal provided him with a fine of $200.50 to pay.

Cited for possession of undersized oysters on Jan. 24, 2002, by NRP Officer R. Bowman, Shockley found the Dorchester County States Attorney very sympathetic to the cause of a pirate poacher of the Chesapeake, perhaps influenced by the waterman’s honest face. The Dorchester States Attorney dropped the charge on March 4, 2002.

Shockley was cited for undersized oysters on Feb. 16, 2000, by NRP J. Massey. In Dorchester County District Court, a plea deal was struck and a verdict of guilty was the result of an amazing sum of ZERO agreed to by the Dorchester County States Attorney who must have felt that the best way of dealing with a guilty Pirate Poacher of the Chesapeake was to apologize for keeping him from his pursuit of illegal oysters.

Cited by NRP Officer Jeffrey Sweitzer for possession of undersize oysters on Feb. 2, 1998, Shockley provided in-court training for the feckless Dorchester County States Attorney on how to best serve a Pirate Chieftain by entering into a plea bargain which gave the taxpayers no protection from a poacher. Shockley was found guilty on March 9, 1998, with no fine and no time.

William H. Jones has been the State’s Attorney for Dorchester County since June 19, 2009. Jones was Assistant State’s Attorney, 2002-04. Senior Assistant State’s Attorney, 2004-07. Interim State’s Attorney, April 11, 2007, to June 19, 2009.

Michelle Barnes served as State’s Attorney for Dorchester County from January 2002 to April 11, 2007. Barnes resigned as States Attorney for Dorchester County in 2007 to take a job with the Maryland Attorney General’s Office in charge of the Environmental Crimes Unit under Attorney General Douglas Gansler. Jones was appointed to fill the vacancy created by Barne’s resignation by Circuit Court Judge Brett W. Wilson on March 20, 2007.

Michael C. Malone was elected the Dorchester County States Attorney in 1998.
