<h2>Police say boozing pedestrian walked out into dark highway and was killed in traffic by DUI driver Terry Berry</h2>
<p><span style="font-size: 12pt;">BEAR, DEL- Booze was the key ingredient in a pedestrian death on Rt. 40 in Delaware over the Labor Day holiday. Both the pedestrian and the driver who hit her were drinking and neither of them belonged on the highway.</span></p>
<p><span style="font-size: 12pt;">The Delaware State Police Collision Reconstruction Unit has identified the female pedestrian who was struck and killed on Saturday, September 5, 2015 just before 11:00 p.m. by a vehicle on westbound US Rt. 40, Pulaski Highway east of Quintilio Drive and west of SR 7, Bear, as Brenda L. Stone, 58, of Dover, Del.</span></p>
<p><span style="font-size: 12pt;">This crash remains under investigation by the Delaware State Police Collision Reconstruction Unit.</span></p>
<p><span style="font-size: 12pt;">The initial investigation has determined that the crash occurred on Saturday, September 5, 2015, at approximately 10:55 p.m., as a female pedestrian was attempting to cross the westbound lanes of US Rt. 40 Pulaski Highway east of Quintilio Drive and west of SR 7, Bear. As the pedestrian attempted to cross the westbound lanes of US Rt. 40 from the north to the south she walked into the center lane and was struck by a 2009 Toyota Camry, which was being operated by Terry Berry, 33, of Newark, Del. After impact, the vehicle continued westbound and made a U-turn and returned to the scene and stopped in the left lane. The woman landed in the left lane after being struck and was later pronounced dead at the scene.</span></p>
<p><span style="font-size: 12pt;">Police say Stone was not utilizing a marked crosswalk at the time of the incident. Her body was turned over to the Division of Forensic Sciences which brought about her identification. Alcohol appears to be a factor on the part of the pedestrian.</span></p>
<p><span style="font-size: 12pt;">Terry Berry was not injured in the crash. He was charged with Driving under the Influence and Operation of an Unregistered Motor Vehicle. However, the primary cause of the collision is the pedestrian violation (failure to use crosswalk).</span></p>
<p><span style="font-size: 12pt;">US Rt. 40 westbound in the area of the crash was closed for approximately three hours as the crash was investigated and cleared.</span></p>
<p><span style="font-size: 12pt;">The Delaware State Police Collision Reconstruction Unit continue to investigate and more details of the crash will be released at the conclusion of the investigation.</span></p>
