Murder USA: Cops charge Caleb Ochse and Christopher Kendall in murder of Justin Daniel Cancelliere

both of Ocean City&comma; are charged with beating a tourist to death outside the Plim Plaza hotel on Sunday Aug&period; 24&comma; 2014&period;<&sol;figcaption><&sol;figure>&NewLine;<p>&nbsp&semi;<&sol;p>&NewLine;<p><span style&equals;"font-size&colon; 14pt&semi;"><strong>Ochse has history of arrests for assault&comma; disorderly conduct&comma; drugs&comma; DUI and affray&&num;8230&semi;&period;wheeling and dealing with prosecutors netted him little jail time&&num;8230&semi;until now&&num;8230&semi;Christopher Kendall has been given repeated get-out-of-jail cards by States Attorney&&num;8230&semi;<&sol;strong><&sol;span><&sol;p>&NewLine;<p>UPDATE  &lpar;August 27&comma; 2014&rpar; –Ocean City Police report that Criminal Investigation Division detectives have arrested two suspects in connection with the August 24th death of Justin D&period; Cancelliere of North Whitehall&comma; PA&period; The two suspects have been identified as Caleb Edwin-Earl Ochse&comma; 27&comma; and Christopher Blake Kendall&comma; 22&period; Both suspects are from Ocean City&comma; MD&period;<&sol;p>&NewLine;<p>On August 24&comma; 2014&comma; Ocean City officers responded to the area of 109 North Atlantic Avenue to assist Ocean City EMS&comma; for a victim of an assault that had already occurred&period;  Upon arrival&comma; officers located Cancelliere unconscious and unresponsive in the parking lot of an area hotel&period; After a thorough investigation&comma; detectives determined the assault occurred during an altercation in the area of Talbot Street and Baltimore Avenue&period;<&sol;p>&NewLine;<p>First responders from the Ocean City Police and Fire Departments initiated emergency lifesaving procedures on Cancelliere and transported him to Atlantic General Hospital&comma; where he was later pronounced deceased&period;<&sol;p>&NewLine;<p>The Office of the Chief Medical Examiner for the State of Maryland has ruled the cause of Cancelliere’s death a <em><strong>homicide&period;<&sol;strong><&sol;em><&sol;p>&NewLine;<p>On August 26&comma; 2014&comma; Ocean City detectives with assistance from the Worcester County Sheriff’s Office Criminal Enforcement Team&comma; arrested Ochse at his place of employment&period; Kendall turned himself in to police at the Ocean City Public Safety Building several hours later&period; Both have been charged with manslaughter&comma; second degree assault&comma; affray and reckless endangerment&period;<&sol;p>&NewLine;<p>Ochse and Kendall are currently being held at the Ocean City Public Safety Building awaiting an initial appearance before a Maryland District Court Commissioner&period;<&sol;p>&NewLine;<p>The current charges were filed by Ocean City Police Officer Carl Perry and consist of manslaughter&comma; affray&comma; reckless endangerment and assault&period;  Ochse has an address listed of Vista Bay Lane in Ocean City with his address until his preliminary hearing on Sept&period; 25<sup>th<&sol;sup> being the jail&period;<&sol;p>&NewLine;<p><strong><em>Ochse was found guilty of DUI<&sol;em><&sol;strong> on April 10&comma; 2012 after being arrested on Nov&period; 5&comma; 2011 at 3&colon;11 am by a Maryland State Trooper as he operated a 1994 Chevy on U&period; S&period; Rt&period; 50 west bound near Inlet Lane in Ocean City&period;  He was represented by attorney Michael Rotwein and was sentenced to one year in jail&period; Ten months and 15 days of the sentence was suspended&period;  Ochse was fined &dollar;400 and assessed court costs of &dollar;30&period;<&sol;p>&NewLine;<p><strong><em>Driving while revoked&colon; <&sol;em><&sol;strong><&sol;p>&NewLine;<p>On July 2&comma; 2009&comma; Ochse was charged with driving while his license is revoked and he entered a guilty plea in a deal with the prosecutor on Jan&period; 6&comma; 2010 which resulted in no jail time and a fine of &dollar;507&period;50 which appears&comma; according to court records&comma; to have not yet been paid&period;<&sol;p>&NewLine;<p><strong><em>Assault and Theft&colon; <&sol;em><&sol;strong><&sol;p>&NewLine;<p>On Sept&period; 20&comma; 2007&comma; Ochse was charged with assault and theft and on Jan&period; 7&comma; 2008&comma; States Attorney Joel Todd dropped both charges against him&period;<&sol;p>&NewLine;<p><strong><em>Drug charges&colon; <&sol;em><&sol;strong> Ochse was charged by criminal information from the States Attorney of Worcester County filed on May 27&comma; 2008&period; A plea deal was struck on Sept&period; 2&comma; 2008 with the prosecutor and Ochse entered a guilty plea to possession of marijuana while six other criminal charges were dropped&period; The plea called for Ochse to be put on supervised probation for two years and pay a fine of &dollar;500&period;  The attorneys on this plea deal were Diane Cuilhe and States Attorney Joel J&period; Todd of Snow Hill&comma; Md&period;  Todd&comma; a Democrat&comma; was States Attorney of Worcester County from 1995 to 2011&period; Todd won a narrow victory over Republican Beau Oglesby in 2006 by a scant 14 votes&period;  Todd garnered 9&comma;857 to 9&comma;843 for Oglesby in the race which wasn’t decided until absentee votes including 38 from overseas were counted two weeks after the election&period;<&sol;p>&NewLine;<p>In 2010&comma; the two squared off again and the results were nearly identical with Republican Oglesby winning by a less than 100 votes&period;<&sol;p>&NewLine;<p>Oglesby is campaigning for reelection this year and his statements on his Facebook page in reference to a recent manslaughter conviction of a defendant who killed a man during a bar fight are a good clue as to how he will prosecute this current case of the two men charged with the manslaughter of Cancelliere&period;  While charges at this time are for manslaughter&comma; more serious charges of first or second degree murder can be added by the States Attorney filing criminal information or taking the case to a Grand Jury&period;<&sol;p>&NewLine;<p>Considering the record of Ochse&comma; it’s a good bet that more charges will be added&period;<&sol;p>&NewLine;<p>In addition to his DUI and drug charges&comma; Ochse also faced charges of assault and disorderly conduct&period;<&sol;p>&NewLine;<p>In a Circuit Court case against Ochse filed on Dec&period; 7&comma; 2012 the Public Defender in Snow Hill worked a plea deal with States Attorney Oglesby&comma; who showed that on that day he was giving away get out of jail free cards for violent offenders&period;<&sol;p>&NewLine;<p><strong><em>The deal on the charges went down this way<&sol;em><&sol;strong>&colon; States Attorney Oglesby dropped the assault charge and Ochse entered a not guilty plea with an agreement and statement of facts on Feb&period; 14&comma; 2013&comma; a notable date due to being Valentine’s Day and it was a sweetheart of a deal for the defendant who had the taxpayers pay for his attorney and all he was penalized was ten days in jail&comma; no probation and a &dollar;500 fine&comma; which in all likelihood has never been paid&period;<&sol;p>&NewLine;<p>&nbsp&semi;<&sol;p>&NewLine;<p><span style&equals;"font-size&colon; 14pt&semi;"><strong>Christopher Blake Kendall<&sol;strong><&sol;span><&sol;p>&NewLine;<p><strong><em> <&sol;em><&sol;strong><&sol;p>&NewLine;<p><strong><em>Two DUI Arrests<&sol;em><&sol;strong><&sol;p>&NewLine;<ol>&NewLine;<li>Kendall&comma; with an address on Jasmine Drive in Wilmington&comma; Del&period;&comma; was cited for failing to obey a traffic signal recently and on May 7&comma; 2014 he was charged with DUI by Ocean City Police Officer Chris Snyder at 12&colon;15 am as he cruised on Coastal Highway at 59<sup>th<&sol;sup> Street&period; He will be tried in Worcester County District Court on this charge on Sept&period; 17&comma; 2014&period;<&sol;li>&NewLine;<li>On March 12&comma; 2011 at 9&colon;52 am&comma; Kendall was arrested and charged by an Ocean City Police officer for DUI and on June 27&comma; 2011 in Worcester County District Court in Ocean City he entered a guilty plea in a deal with States Attorney Beau Oglesby and given no jail time and fined &dollar;500 along with &dollar;30 in court costs&period;<&sol;li>&NewLine;<&sol;ol>&NewLine;<p>Attorney Jeffrey G&period; Ray represented Kendall on that arrest as he does on the current DUI&period;<&sol;p>&NewLine;<p><strong><em>Possession of marijuana and drug paraphernalia&colon;<&sol;em><&sol;strong><&sol;p>&NewLine;<ol>&NewLine;<li>Two counts of possession of paraphernalia and pot were disposed of in Worcester County District Court on Feb&period; 9&comma; 2011 with a guilty plea to one charge and the pot possession dropped by Worchester County States Attorney Beau Oglesby&period; A &dollar;300 fine and court costs of &dollar;22&period;50 were assessed as part of the deal arranged by his attorney&comma; Jeffrey G&period; Ray&period;<&sol;li>&NewLine;<li>On Aug&period; 8&comma; 2010&comma; Kendall was charged with possession of paraphernalia and marijuana and in a plea deal approved by Worcester County States Attorney Beau Oglesby&comma; on Feb&period; 9&comma; 2012&comma; he pleaded guilty and was fined &dollar;300 and court costs to the pot charge and the other charge was dropped&period;<&sol;li>&NewLine;<li>When charged on Christmas Eve 2010 with possession of drug paraphernalia&comma; the charges against Kendall were dropped by States Attorney Oglesby on March 18&comma; 2011&period;<&sol;li>&NewLine;<&sol;ol>&NewLine;<p><strong><em>Indecent Exposure and Disorderly Conduct&colon;<&sol;em><&sol;strong><&sol;p>&NewLine;<p>On April 27&comma; 2012 charges were lodged against Kendall for the above and both charges were dropped by Worcester County States Attorney Oglesby on Jan&period; 9&comma; 2013&period;<&sol;p>&NewLine;<p><strong><em>Malicious Destruction of Property&comma; Disturbing the Peace&comma; Reckless Endangerment&colon;<&sol;em><&sol;strong><&sol;p>&NewLine;<p>Charges brought by Maryland State Trooper S&period; Sears in the above matter on March 11&comma; 2012 came to trial in Worcester County District Court on July 10&comma; 2012&period;  In another plea deal approved by Worcester County States Attorney Beau Oglesby&comma; Kendall’s charges were all put on the stet docket&comma; which means he has to stay crime-free for one year&period;  Kendall was represented by Richard A&period; Parolski of Snow Hill&comma; Md&period;<&sol;p>&NewLine;<p>&nbsp&semi;<&sol;p>&NewLine;<p><strong>Man found beaten to death<&sol;strong><&sol;p>&NewLine;<p><strong> <&sol;strong>&lpar;August 25&comma; 2014&rpar; – According to Ocean City Maryland Police&comma; on August 24&comma; 2014&comma; at approximately <span data-term&equals;"goog&lowbar;537143911">3&colon;12 a&period;m&period;<&sol;span> Ocean City police were dispatched to area of 109 North Atlantic Avenue to assist Ocean City EMS&comma; for a victim of an assault that had already occurred&period; Upon arrival&comma; officers located an adult male that was unconscious and unresponsive in the parking lot of an area hotel&period;<&sol;p>&NewLine;<p>First responders from the Ocean City Police and Fire Departments initiated emergency lifesaving procedures on the victim and transported him to Atlantic General Hospital&comma; where he was later pronounced deceased&period; The victim has been identified as <strong>Justin Daniel Cancelliere<&sol;strong>&comma; 37&comma; North Whitehall&comma; PA&period;<&sol;p>&NewLine;<p>An investigation into the cause&comma;
