<span style="font-size: 12pt;">(RHODESDALE, MD) April 5, 2015 – Sometimes it’s a blessing when the courts continue to let dirtbags who belong in prison back out of custody to torture their families and society in general. The case of Eugene W. Tolley Jr., just might be another one of those times.<br />
The Maryland State Police report that a man is dead and his wife is in the hospital after an apparent violent domestic situation ended in a homicide overnight in Dorchester County.<br />

<span style="font-size: 12pt;"> The deceased is identified as Eugene W. Tolley, 59, of the 5700-block of Galestown Reliance Rd., Rhodesdale, Md. He was pronounced dead at the scene.</span><br />
<span style="font-size: 12pt;"> The injured person is identified as Nancy J. Tolley, 57, the deceased’s wife, of the same address. She is undergoing treatment at Dorchester General Hospital for an injury to her head and other complications.</span><br />
<span style="font-size: 12pt;"> No charges have been filed at this time. The Dorchester County state’s attorney has been briefed on the preliminary investigation and is expected to present evidence in this case to a Grand Jury for consideration of charges.</span><br />
<span style="font-size: 12pt;"> Just before 3:00 a.m. today, Maryland State Police at the Easton Barrack received a 911 call from a female at the victim’s address reporting a shooting. The caller identified herself as the victim’s wife.</span><br />
<span style="font-size: 12pt;"> Arriving troopers found a man, later identified as Eugene Tolley, lying in the driveway. He appeared to have sustained at least one gunshot wound. A handgun was found on the ground not far from the body. EMS personnel responded and pronounced the victim deceased.</span><br />
<span style="font-size: 12pt;"> Maryland State Police Homicide Unit investigators responded to conduct the investigation. They were assisted by personnel from the State Police Criminal Enforcement Division, the Crime Scene Unit and Easton Barrack personnel.</span><br />
<span style="font-size: 12pt;"> The preliminary investigation indicates the victim and his wife became involved in a domestic argument early this morning in the garage of their home. Investigators developed information indicating the victim may have been assaulting his wife, which included inflicting the injury to her head. While he was continuing to threaten her, preliminary evidence indicates Mrs. Tolley retrieved a gun from the house and shot her husband as he approached her.</span></h3>

<p><span style="font-size: 12pt;">Investigators are looking into a history of domestic violence involving the victim. Further information is being obtained from scene evidence and ongoing interviews.</span></p>
<p><span style="font-size: 12pt;">Eugene Tolley was divorced by Teresa M. Tolley on June 3, 2011 in Caroline County Circuit Court, according to court records.</span><br />
<span style="font-size: 12pt;"> Prior to that divorce, domestic violence cases were sought against Tolley in 2007 and 2009.</span></p>
<p><span style="font-size: 12pt;">On Oct. 2, 2008, Tolley was found guilty of assault in Dorchester County Circuit Court from an incident that occurred on March 4, 2008. He was sentenced to nine years and six months in prison with all but twenty-eight days of the sentence suspended. Five years of probation was tacked on to the sentence.</span><br />
<span style="font-size: 12pt;"> By the 28th of 2011 an order was issued by the court for violation of the terms of Tolley’s probation.</span><br />
<span style="font-size: 12pt;"> On Oct. 26, 2011, court records reflect that he was jailed and then released after posting ten percent of a bond of $5,000 on the condition “do not harm of any kind to wife, physical or verbal”.</span><br />
<span style="font-size: 12pt;"> Client “progress reports” were provided to Judge Brett Wilson and were marked “sealed / confidential”.</span><br />
<span style="font-size: 12pt;"> On two occasions orders for Tolley’s “Temporary commitment” were issued by a Circuit Court Judge with one such order issued on March 22, 2012.</span><br />
<span style="font-size: 12pt;"> On April 3, 2012, Judge Wilson signed an order for probation, setting Tolley free once again.</span><br />
<span style="font-size: 12pt;"> On March 13, 2013 the court records were again marked “sealed/confidential” as a “progress report” was filed with the court.</span><br />
<span style="font-size: 12pt;"> On Nov. 22, 2013, the case file terminated with the appearance of Tolley’s attorney, Raymond H. Simmons, ending his representation.</span></p>
